The present application has been filed for restoration of Cr. Misc. No. 43740 of 2025, in which the matter was dismissed for non-prosecution as learned counsel for the petitioner was not interested in pursuing the case. 3.

Learned counsel for the petitioner submits that the Advocate-on-Record for the petitioner could not appear due to bonafide, unavoidable reasons and non-appearance was neither intentional nor deliberate and, therefore, Cr. Misc. No. 43740 of 2025 got dismissed for non-prosecution.

For the reasons stated in this application, the prayer made therein is allowed and, as a result, the Cr. Misc. No. 43740 of 2025 is restored to its original file.
