The petitioner is apprehending arrest in a case registered for the offences punishable under Section 302/120B of the Indian Penal Code and 27 of the Arms Act. The prosecution case is that the informant being daughter-in-law of the victim was informed by the son of her brother-in-law that someone has fired causing bleeding injury to mother-in-law of the informant when suspicion was raised against Sanjay Singh, who had been putting pressure on the informant's mother-in-law for selling a piece of land, leading to registration of the FIR against Sanjay Singh. The name of the petitioner sprang up in the confession of Raja @ Raj Kumar
Patna High Court Cr.Misc. No.55241 of 2015 (3) dt.10-12-2015 2/2 when he was arrested in connection with Danapur P.S. Case No.394/14.
It is submitted by learned counsel for the petitioner that except the confession of the co-accused, there is nothing against the petitioner and the witnesses have raised suspicion only against Sanjay Singh. Admittedly, there is no eye witness to the occurrence and co-accused Raja has been granted regular bail by a co-ordinate bench of this court vide Criminal Miscellaneous No.11115/15.
The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Danapur P.S. Case No.213 of 2014, pending before the learned ACJM, Danapur, Patna.
With the above observation, this application is, accordingly, disposed off.
