Mr. Abbas Haider, SC 6 Mr. Ranjay Kumar Singh, AC to SC 6 ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJAN GUPTA and HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER (Per: HONOURABLE MR. JUSTICE RAJAN GUPTA) 22-08-2022 Heard learned counsel for the parties.

The petitioner has filed this writ in the nature of mandamus for directing the respondent authority to pay compensation to the petitioner on multiplying basis on the existing circle rate against the lands as described in the headnote of the petition. At the outset, learned counsel for the petitioner has placed reliance on a judgment in the case of Sujeet Kumar vs.

Patna High Court CWJC No.11209 of 2021(8) dt.22-08-2022 2/2 Power Grid Corporation of India Limited reported in 2021(4) PLJR 631, to contend that before laying of the telegraph line, no notice is required to be issued to the petitioner. However, he is entitled to compensation as per law.

Admittedly, the petitioner has filed representation before the competent authority but no decision has been taken thereon nor decided.

As a result, we dispose off the writ petition with a direction to the concerned authority to decide the representation expeditiously in any case, not later than eight weeks. The parties shall be at liberty to file supplementary affidavits, if so required. The writ petition stands disposed off.
