JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 25-01-2016 Heard counsel for the petitioners and the informant. In substance, the allegation is that on representation made by the petitioners, the informant agreed to purchase the land for certain amounts. In spite of payment thereof, the land has not been conveyed.
Mr. Mishra, on instruction, states that both the parties are negotiating and there is chance of settlement. The counsel for the informant, however, has submitted that he has on such instruction.
Considering the said stand of the petitioner, the application stands disposed of with the following observation:-

No.53305 of 2015 (3) dt.25-01-2016 2/2 If petitioners surrender before the Court below within 08 weeks from today and produce the settlement document, the trial Court shall release the petitioners on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Kadamkuan P.S. case no. 183 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. with further following conditions :- (i) One of the bailors shall be the own/close family members of the petitioners.
(ii) As soon as the charges are framed the petitioners shall appear in person before the trial Court on the date(s) fixed at the trial. In case of default in such appearance on two consecutive dates, the trial Court shall have liberty to cancel the bail bonds of the petitioners and secure their arrest in accordance with law.
