The petitioner apprehends his arrest in connection with Kako P.S. Case No. 157 of 2016 registered under Sections 341, 323, 504 of the Indian Penal Code and 27 of the Arms Act. The accusation is that due to land dispute quarrel was going on between the wife of Vijay Prasad and informant Suryadeo Prasad. In the meantime, this petitioner reached there and started firing. In spite of gathering of the villagers, this petitioner did not stop the firing. Thereafter, wife and daughter-inlaw of Suryadeo Prasad, who were present there, fled away and concealed themselves in the house locking the door. At that time, this petitioner has also given threatening to kill them.
Patna High Court Cr.Misc. No.52818 of 2016 (2) dt.07-12-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that due to land dispute, the petitioner has been implicated in this case with false allegation of firing, but it would appear from the F.I.R. that none has sustained fire arm injury. It is also submitted that petitioner has no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Judge-4, Jehanabad in connection with Kako P.S. Case No. 157 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
