2. Petitioner apprehends arrest in a case registered for the offence punishable under section 379 of IPC .
3. As per F.I.R., the motorcycle of the informant was stolen by unknown miscreants.
4. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., and he is innocent and has falsely been implicated in this case . There is no eye witness to the alleged occurrence . Neither there is any recovery of alleged motorcycle in question from the possession of the petitioner nor he is connected with the alleged occurrence .
5. Learned counsel for the State opposes the prayer for bail and submits there is specific allegation against the
Patna High Court CR. MISC. No.28667 of 2024(2) dt.14-05-2024 2/2 petitioner is that during investigation this petitioner was seen riding the motorcycle in question with fake registration number. The alleged stolen motorcycle was recovered from the possession of the petitioner for which Itarhi P.S. Case No. 205 of 2023 has been registered. Petitioner has got three criminal antecedents.
6. Considering the nature of accusation and also the fact that petitioner has got three criminal antecedents, prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
