JUSTICE ARUN KUMAR ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Mohania P.S. Case No.92 of 2017, registered under Section 396 of the Indian Penal Code.

Allegation in brief is that road robbery was committed by some miscreants and looted the informant and one of the persons sitting in the vehicle was killed in the incident by firearm. After investigation, police has gathered some evidence against this petitioner.

Learned counsel for the petitioner submits that the petitioner's name was disclosed by one of the co-accused during investigationm except that there is no other material against him. Considering the nature of offence and up-till-now

Patna High Court Cr.Misc. No.37324 of 2017 (2) dt.10-08-2017 2 / 2 material collected during investigation as referred in the impugned order, the prayer of anticipatory bail of the petitioner stands rejected in connection with Mohania P.S. Case No.92 of 2017, pending in the court of the learned Chief Judicial Magistrate, Kaimur at Bhabhua.
