JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,149,341,323,504,379 and 302 of the Indian Penal Code. The prosecution case is that some altercation started between the informant and co accused Mangal Manjhi, in the meantime, the accused persons including the petitioner came and started assaulting the informant. On hearing alarm, the cousin brother of the informant namely Arjun Manjhi came to rescue then he was assaulted. The accused persons took ten thousand rupees from the informant.
Initially, the case was registered under sections
Patna High Court Cr.Misc. No.54572 of 2015 (2) dt.02-12-2015 2/2 147,149,341,323,504,379 IPC but subsequently, on the death of Arjun Manjhi, section 302 IPC was added.
It is submitted by the learned counsel for the petitioner that the accusation is omnibus and general and the victim died after two days of the occurrence. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Nagarnausa P.S. Case No. 111 of 2015 pending in the court of learned J.M. Hilsa, Nalanda.
This application is disposed of with the aforesaid observation/direction.
