Petitioners apprehend his arrest in connection with Manihari P.S. Case No. 62 of 2016 registered under Sections323, 376, 225 of the Indian Penal Code. Learned counsel for the petitioners submits that initially a complaint case was filed which was later on registered as first information report. That too has been lodged after delay of one year without any explanation. The present false case has been filed only to put pressure for marriage. There is no medical report to suggest commission of rape. Petitioners have no criminal antecedent.

Considering the facts and circumstances of the

Patna High Court Cr.Misc. No.15322 of 2017 (4) dt.17-08-2017 2/2 case, the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Katihar in connection with Manihari P.S. Case No. 62 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
