In this case, the petitioner is seeking anticipatory bail in connection with Mairwa P.S. Case No. 367 of 2018, registered for the offence under Sections 272, 273, 308/34 of the Indian Penal Code and under Section 30(a), 38(i), 41(1) of the Bihar Prohibition and Excise Act, 2016.

A Honda City car, which was coming from the side of Uttar Pradesh, was intercepted, from there huge quantity of liquor has been recovered. The person, who was arrested, disclosed that the person, who has fled away, is the present petitioner.

Looking to the nature of allegation, this Court is

Patna High Court CR. MISC. No.28981 of 2019(2) dt.02-05-2019 2/2 not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
