JUSTICE ARVIND SRIVASTAVA ORAL ORDER 09-02-2017 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends his arrest in connection with Angarghat P.S. Case No. 09 of 2014 registered under Sections 341,323,325,307,379, and 504/34 of the Indian Penal Code. The allegation against the petitioner is of assault to the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and due to inimical term, in collusion with doctor and the police, the present case has been lodged. It is further submitted that other similarly situated co-accused has already granted anticipatory bail in Cr. Misc. No. 42349 of 2016 on 17.10.2016 and in Cr. Misc. No. 46966 of 2016 on

Patna High Court Cr.Misc. No.52271 of 2016 (6) dt.09-02-2017 13.12.2016.

Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Dalsingsarai, Samastipur in connection with Angarghat P.S. Case No. 09 of 2014 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
