2. Mr. Manoj Kumar, learned counsel appearing on behalf of opposite party no.2 is present.

3. The present application has been filed for quashing the order dated 25.07.2016 passed by learned 1st Additional Sessions Judge, Nalanda at Biharsharif in S.T. No.560 of 2014 whereby the trial court has rejected the petition preferred under Section 227 of the Code of Criminal Procedure (for short 'CrPC').

4. It appears that vide order dated 19.12.2023, a report regarding status of proceedings was called for. From

Patna High Court CR. MISC. No.41401 of 2016(5) dt.12-02-2024 2/2 perusal of the report dated 03.01.2024 sent by A.D.J.-VIII, Biharsharif, Nalanda, it appears that charges have already framed in this case and further four prosecution witnesses have already examined.

5. In view of above, after short argument, learned counsel appearing on behalf of petitioner seeks permission to withdraw the present application.

6. Permission is accorded.
