The petitioner apprehends his arrest in Bhargama P.S. case No. 98 of 2018 registered under Section 363, 365/34 of the IPC.

The informant alleged that his niece became traceless from her in-laws house on 06.05.2018. Her husband and fatherin-law were always torturing her. The learned counsel for the petitioner submits that petitioner is father-in-law of the niece of the informant. The victim made her statement u/s 164 of the Cr. P. C. and she disclosed that on account of assault made by her husband and other in-laws she left the house and went to the house of her friends. The niece of the informant did not make any specific allegation of assault against the petitioner.

No.24516 of 2019(2) dt.16-04-2019 2/2 Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Bhargama P.S. case No. 98 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
