JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-11-2015 Petitioners being sister and parents of the husband of the daughter of the informant are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504, 498A, 313/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. The basic accusation is of torture for nonfulfilment of dowry demand. It is also alleged that pregnancy of the daughter of the informant was terminated in 2009. It is submitted by learned counsel for the petitioners that accusation is omnibus and general. There is nothing on record to suggest that in 2009 the pregnancy was terminated and the daughter of the informant is still residing at her matrimonial house. Moreover thrust of accusation is
Patna High Court Cr.Misc. No.52569 of 2015 (2) dt.10-11-2015 2/2 against the husband of the daughter of the informant. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Nagarnausa P.S.
