The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act.

It is a case of dowry death. Allegation is that petitioner along with others caused death of daughter of informant due to non-fulfilment of demand of dowry. It is submitted that petitioner is brother-in-law (Dewar) of the deceased. Allegation of torture for dowry is general and omnibus. Main accusation is against husband of the deceased who is already in custody. Petitioner is separate in mess and property and has got no concern with the family

Patna High Court CR. MISC. No.26415 of 2022(2) dt.20-09-2022 2/2 affairs of the deceased. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Danapur, Patna in connection with Naubatpur P.S. Case No. 35 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
