The petitioner is public representative and is raising a grievance against choosing Middle School Budhsi under Sidhwalia Block for upgradation as High School. According to her, the Middle School Kabirpur is the best suited for such upgradation considering the infrastructure as well as the location it has. In the counter affidavit, the respondents have placed on record the comparative chart of the availability of the infrastructure in both the schools. This is intrinsically an administrative decision of the State respondents who has jurisdiction to appraise the relevant factors and decide which school falling in the Gram Panchayat should be upgraded.

Patna High Court CWJC No.20316 of 2013 (2) dt.24-06-2016 2/2 Counsel for the petitioner has submitted that liberty be granted to raise a grievance against the non upgradation of Middle School, Kabirpur before the District Collector for consideration and disposal in accordance with law. The writ application stands disposed of permitting the petitioner to approach the respondent -Collector raising the grievance as raised in this application for consideration and disposal in accordance with law as quickly as possible preferably within three months from the date of making of such representation.
