The petitioner apprehends his arrest in Begusarai Town P.S. Case No. 363 of 2016 for offences under Sections 307 of the Indian Penal Code and 25(B)a and 26 of the Arms Act. The prosecution case is that on 07.08.2016 while the informant was sitting at his shop, in the meantime, the petitioner came armed with pistol and abused the informant. On protest being made, the petitioner fired causing injury on the right hand finger of the informant.
It is submitted by the learned counsel for the petitioner that the father of the petitioner Paras Nath Das filed Complaint Case No. 1650 of 2016 with accusation under Section 307, 323, 452, 427 and 354 of the Indian Penal Code and 3(i)(x) (xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, against the informant prior to the present case wherein the processes have been directed to be issued after cognizance being taken.
Considering the aforesaid facts, let the learned Court
Patna High Court Cr.Misc. No.46039 of 2016 (2) dt.22-10-2016 below consider prayer of the petitioner for bail in case the petitioner surrenders within six weeks in connection with Begusarai Town P.S. Case No. 363 of 2016 pending in the Court of the Chief Judicial Magistrate, Begusarai.
With the aforesaid observations/directions, this application is disposed off.
