ANJANA MISHRA ORAL ORDER 19-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 08.03.2019 in connection with Excise Case No.434/19 (Piro P.S. Case No. 67 of 2019) registered for the offence under Sections 30(a), 38(ii) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that admittedly the recoveries were made from the open field and the petitioner is the owner of rice mill. It has further been submitted that the alleged recoveries were not made from the conscious possession of the petitioner.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten Thousand)

Patna High Court CR. MISC. No.25258 of 2019(2) dt.19-04-2019 2/2 with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act, Bhojpur, Ara, in connection with Excise Case No.434/19 (Piro P.S. Case No. 67 of 2019).
