Mr.APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-09-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Nanpur P.S. Case No. 226 of 2019 for the offence under Sections 30(a) and 38 of the Bihar Prohibition and Excise Act. In the instant case total 813.765 litres of foreign liquor was seized from a Pick-up van.

Learned counsel for the petitioner submits that the petitioner is aged about 19 years and has got no criminal antecedent. He further submits that nothing was recovered from the possession of the petitioner.

Considering the age of the petitioner and the fact that he has got no criminal antecedent and nothing was recovered from his conscious possession, the petitioner named above, in the event of arrest or surrender before the court below

Patna High Court CR. MISC. No.22501 of 2020(2) dt.03-09-2020 2/2 within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Excise, Act, Sitamarhi in connection with Nanpur P.S. Case No. 226 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure with the further condition that on release the petitioner will render his service as volunteer for a period of one month in dedicated Covid Hospital. He is required to report to the District Nodal Officer in the concerned region, who shall utilize his service in this pandemic.
