The petitioner apprehends his arrest in Alouli P.S. Case No. 224/2017, registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code. The informant alleged that his tailor was stolen, but he came to know on 9.07.2017 that his tailor was kept in the police station. Further he came to know that Sanjay Mahto and the petitioner Digvijay Mahto had stolen the said tailor. Learned counsel for the petitioner submits that name of the petitioner figured in the case in the confessional statement of Sanjay Mahto, on whose instance, the tailor was recovered, but nothing has been recovered from possession of the petitioner. It appears that Sanjay Mahto, from whose possession
Patna High Court Cr.Misc. No.43922 of 2017 (2) dt.22-09-2017 2/2 the tailor was recovered from his Darwaja, has disclosed the name of the petitioner. Petitioner has also got criminal antecedent and he is accused in a case registered under Section 392 of the Indian Penal Code.
Considering the facts aforesaid and the fact that the petitioner has got criminal antecedent. I am not inclined to enlarge the petitioner, above named, on anticipatory bail. Accordingly, the same is rejected.
