JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 24-07-2018 The present writ petition has been filed for quashing the confiscation proceeding bearing Confiscation Case No. 50/2013-14 arising out of Jainagar P.S. Case No. 165 of 2013 for offence under Section 7 of the E.C. Act initiated before the Collector, Madhubani against the petitioner and further directing and commanding the respondents authorities for payment of compensation and hire charges @ Rs. 5000/- per day with effect from the date of seizure to the date of its release to the petitioner for his seized Truck bearing Registration No. BR-01GA-4202.

2. After some arguments, learned counsel for the petitioner seeks permission to withdraw the writ petition to raise the contention that the order of cognizance dated 20.06.2014 taken against one Niraj Kumar Gupta, owner of the food grains has been quashed by this Court in Cr. Misc. No. 45961 of 2014, before the concerned authority in Confiscation Proceeding No. 50/2013-14 for appropriate consideration.
3. Permission is accorded. The writ petition accordingly stands dismissed.
