This application, for grant of anticipatory bail, arises out of Durgawati Police Station Case No. 112 of 2017, disclosing offences under Sections 409 and 420 of the Indian Penal Code and Section 7 of the E.C.Act.
Learned counsel for the petitioner has submitted that there is general and omnibus allegation against this petitioner and no specific overt act is attributed to him. In fact, the petitioner happens to be P.D.S. dealer for the last 20 years and no irregularity has been committed by the petitioner ever in distribution of K.Oil and rice and wheat. The petitioner has falsely been implicated in this case and no case under Section 7
Patna High Court Cr.Misc. No.8377 of 2018 (2) dt.17-02-2018 of the E.C. Act is made out against the petitioner. Hence, the petitioner deserves the privilege of anticipatory bail. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Cum- Special Judge, Kaimur at Bhabhua, in connection with Durgawati Police Station Case No. 112 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
