Petitioners apprehend arrest in connection with Jokihat P.S. Case No.248 of 2016 registered for the offences under Sections 147, 148, 341, 323, 324, 307, 354(B), 379, 504 and 506
Patna High Court Cr.Misc. No.3448 of 2018 (2) dt.02-02-2018 of the Indian Penal Code.
It has been submitted that on the date of occurrence both parties indulged in scuffle for which case and counter case were registered. In the present case, there are altogether 32 accused persons out of them 22 are petitioners before this court. Out of the aforesaid petitioners, the allegation of assault is specific against petitioner nos.3 and 7 but there is no repetition of blow by the petitioners. It has further been submitted that both parties are residents of same place and on account of intervention of wellwishers the case has been compromised. The learned A.P.P. for the State opposed the submission.
Considering the facts and circumstances of the case, the prayer for bail is allowed and the above named petitioners, in the event of arrest or surrender before the learned court below within six weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the likewise amount each to the satisfaction of learned A.C.J.M., Araria in connection with Jokihat P.S. Case No.248 of 2016 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
