JUSTICE PRABHAT KUMAR JHA ORAL ORDER 02-04-2019 This appeal has already been dismissed against Respondents No.1(a), 1(d) and 1(f) to 1(h). The office points out that whether the appeal shall be abated as a whole? The plaintiff filed the suit for declaration that registered sale deed dated 16.05.1987, executed by Syed Manjurul Hasan, is forged, fabricated, collusive and void ab initio and as such not binding on the plaintiff and for declaration that the defendants have got no right and title over the land by virtue of such sale deed. The suit was allowed. The appeal preferred by the defendants was dismissed on 06.01.2006. The appellants are the defendants. If the appeal against some of the respondents such as Respondents No.1(a), 1(d) and 1(f) to 1(h) has already been dismissed, the appeal will not survive against other respondents as same and similar relief is sought against all the respondents.
