The petitioner apprehends his arrest in connection with Madanpur P. S. Case No. 37 of 2017 registered for the offences punishable under Sections 341, 323, 354, 307, 324, 504/34 of the Indian Penal Code.

In the first information report against the petitioner there is allegation that he assaulted the husband and father-in-law of the informant with sword.

Submission is of false implication and that the father-inlaw and husband of the informant both have received lacerated wounds and opinion have been kept reserved and as such the petitioner deserves sympathetic consideration.

Patna High Court Cr.Misc. No.44408 of 2017(2) dt.21-09-2017 2/2 Learned APP opposes the prayer of pre-arrest bail by submitting that by sword also lacerated wound can be caused and the injuries are on vital part of the body. In the facts and circumstances stated above, considering the allegation, this Court is not inclined to grant privilege of pre-arrest bail to the petitioner and accordingly, his such prayer stands rejected.
