JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 02-02-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 153A, 153B, 295A, 341, 323, 353, 327, 379, 427, 435, 504, 506, 307, 354, 504, 506 of the Indian Penal Code and Section 3⁄4 of the Prevention of Damage of Public Property Act. Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in this case. He submits that there is general and omnibus allegation levelled against the petitioners. He submits that similarly situated co-accused has been granted bail by coordinate Bench of this Court in Cr. Misc. No. 85613 of 2019 on 24.01.2020. He

Patna High Court CR. MISC. No.34460 of 2021(2) dt.02-02-2022 2/2 further submits that petitioner no. 1 and 2 have no criminal antecedent whereas petitioner no. 3 has one criminal antecedent as stated in para-3 of this application.

Considering the facts that there is general and omnibus allegation against the petitioners, the above named petitioners in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sourbazar (Baijnathpurn OP) P.S. Case No. 176 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
