====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 01-12-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Teghra P. S. Case No.385 of 2020, instituted for the offences under Sections 392/ 397 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 06.02.2021 and charge-sheet has been submitted in this case.

The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that the informant alleges that he is a government servant and when he was returning home from his Block Office, Bachhwara and when he reached near Gaura Chaur Bhawara, he was surrounded by three persons on a motorcycle and waylaid.

Patna High Court CR. MISC. No.33939 of 2021(2) dt.01-12-2021 2/3 They looted at gunpoint his Pulsar motorcycle, mobile phone, cash of Rs.18,00/-, a blanket and a bag containing owner book, pan card, Aadhar card, residential certificate, income certificate etc. were looted.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. His name has come in the confessional statement of co-accused Suraj Kumar from whom the mobile was recovered and further, the mobile which was recovered from this petitioner is not tallied with the I.M.E.I. number of stolen mobile.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 06.02.2021 and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Teghra P. S. Case No.385 of 2020, with a condition that till the charges are not framed, the petitioner will mark his attendance before the concerned police station on 15th of every month commencing from December, 2021 and in the
