The petitioner apprehends his arrest in connection with Sitamarhi P.S. Case No. 176 of 2017, registered under Sections 363 and 366A/34 of the Indian Penal Code.

The accusation is of kidnapping the daughter of the informant by the petitioner with the help of four others for the purpose to perform the marriage.

Learned counsel for the petitioner submits that, in fact, daughter of the informant had moved from her house with the petitioner according to her own sweet will and performed marriage with the petitioner in the temple in Nepal, which would appear from her statement recorded under Section 164 of the Cr.P.C.
