The petitioner apprehends his arrest in connection with Lodipur P.S. Case No.96 of 2014 for the offences punishable under section 394 of the Indian Penal Code. Mr. Praveen Kumar, learned counsel appearing for the petitioner submits that although charge-sheet under sections 397 and 412 of the Indian Penal Code has been submitted but that is against the co-accused. He further submits that the FIR is against unknown. He also submits that except the name of the has transpired on the basis of the confessional statement of coaccused nothing transpired to connect the petitioner with the alleged offence and that he has no criminal antecedent. Raman, the learned Judicial Magistrate 1st Class, Bhagalpur in connection with Lodipur P.S. Case No.96 of 2014 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
