Mr. Yogendra Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 25-11-2020 As of now the Courts have not resumed normal physical hearing, the matter has been listed today for consideration through Video Conferencing.

The learned counsels are appearing and making submissions from their residence. The Court Master and Secretary are also part of this virtual court proceedings from their homes, all with the aid of audio visual technology.

Mr. Yogendra Kumar Singh, APP is appearing for the State as it is submitted that the brief has been allotted to him by the office of Advocate General.

Heard learned Counsel for the petitioner and the learned Counsel for the State.

This Court would expect that the petitioner's Counsel would honour his undertaking in the instant proceedings regarding supply of requisite court fee etc. within two weeks from the date he is called upon to do so by the office.

Petitioner seeks bail in Gorul (Kathara O.P.) PS Case No. 127 of 2020 registered under Sections 341, 323, 337 and 302 of the IPC.

Learned Counsel for the petitioner submits that as per prosecution case one Awadhesh Kumar was accompanying the deceased. During investigation Awadhesh Kumar has not stated about the deceased being there when the petitioner was throttlting him. Learned APP has draws attention of the Court towards the statement of the villagers recorded in para 6 and 7 of the case diary. They have fully supported the allegation of murder committed by the petitioner. The petitioner is now in custody since 17.4.2020 and there is also criminal antecedent.

Considering the rival submissions, for the present, this Court is not inclined to allow the prayer for bail. The same is rejected.
