JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-11-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Kotwali P.S. Case No. 268 of 2017 registered for the offence punishable under sections 420, 408, 120B/34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that the file relating to the loan of the petitioner appears to have been removed by the guard of the Bank and petitioner has been implicated in this case merely on suspicion. Petitioner was always ready to settle the loan amount, but the bank was biased and has lodged the present false case.

Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that the Guard of the bank in his confessional statement has admitted that he handed over the

Patna High Court Cr.Misc. No.44254 of 2017(3) dt.08-11-2017 2/2 loan file to this petitioner. During investigation, the informant and several other witnesses have supported the prosecution case. Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
