The petitioner apprehends his arrest in a case punishable for the offence under Sections 323, 504, 354 of the Indian Penal Code.
As per complaint case, on 10.09.2018 at about 6:30 PM, while the complainant was alone at her house, this petitioner entered into the house and tried to commit rape upon her and on protest, he assaulted the complainant. It is submitted on behalf of petitioner that petitioner is own pattidar of the complainant and due to land dispute between the parties, this false case has been lodged against this petitioner. The houses of the petitioner and complainant are situated side-by-side. Petitioner has got clean antecedent.
Patna High Court CR. MISC. No.26312 of 2022(2) dt.20-09-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupri at Sitamarhi in connection with Complaint Case No. 312 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
