JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

In huge quantity, Nepali liquor was recovered from bamboo clumps and petitioner was made accused in respect of the aforesaid recovery of Nepali liquor. Petitioner is in jail custody since 29.01.2019.

No doubt, earlier petitioner was made accused in Bajpatti P. S. Case No. 250/18 registered under various sections of Bihar Excise Act but considering the aforesaid facts of the

Patna High Court CR. MISC. No.24609 of 2019(2) dt.17-04-2019 2/2 present case as well as period of detention of petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additonal Sessions Judge-II cum Special Judge, Excise Act, Sitamarhi in connection with Bajpatti P.S. Case No. 331 of 2018.
