Inter alia contending that direction issued by this Court on 21.08.2009 in C.W.J.C. No. 10275 of 2009 has not been complied with, this application has been filed for initiating action for contempt.

In the matter of payment of dues to the employees concerned, the writ petition was filed and the Patna Municipal Corporation was directed to decide the claim of the employees by a speaking order and pay to them the dues as are payable. Show-cause has been filed by the Patna Municipal Corporation appending Annexure-A which indicates that the representation pertaining to payment of arrears of salary has been decided and the employees to whom the amount was payable, it has been calculated and paid in their favour, as is evident from the list of 46 employees indicated in the order Annexure-A.

Patna High Court MJC No.1684 of 2010 (2) dt.10-08-2017 2/2 That being so, now no further action is required to be taken in the matter. Further undertaking is also given in the showcause that as and when other employees come, the payment due to them shall be made.

Keeping in view the aforesaid, now after a period of more than 7 years no case is made out for initiating action for contempt. In case the employees have any grievance still subsisting in the matter, they are granted liberty to initiate fresh proceedings in accordance with law.

With the aforesaid, the application stands disposed of. (Rajendra Menon, CJ) P.K.P.
