JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 03-10-2017 The present petition has been filed for transfer of Matrimonial Case No. 121 of 2015 pending before the court of learned Principal Judge, Family Court, Muzaffarpur to the court of learned Principal Judge, Family Court, Jehanabad.

2. It appears that subsequent to the order of this Court dated 01.09.2017, the opposite party has made payment of the remaining amount, out of Rs. 11,50,000/-, to the learned counsel for the petitioner and as such the terms of compromise dated 11.05.2017 (Annexure-A to the counter affidavit) have been fulfilled by the opposite party. However, it is stated that despite receiving the entire amount in terms of the compromise, the petitioner is now not coming forward to file the joint petition before the learned Principal Judge,

3. Learned counsel for the petitioner accepts that the amount received by him from the learned counsel for the opposite party has been delivered to the petitioner but despite all the attempts, she is not coming forward to abide by the terms of the compromise.

4. Having regard to the submissions of the learned counsel for the parties, this Court is not inclined to grant the relief sought by the petitioner for transfer of Matrimonial Case No. 121 of 2015 from the court of learned Principal Judge, Family Court, Muzaffarpur to the court of learned Principal Judge, Family Court, Jehanabad.
