The petitioner apprehends his arrest in connection with Purnahiya P. S. Case No. 62 of 2017 registered for the offences punishable under Sections 147, 148, 149, 323, 341, 386, 387, 489, 427, 440, 436, 455, 457, 354, 354A, 448 of the Indian Penal Code.

Allegedly, on 20.07.2017 Kishan Das son of Pintu Das aged about 8 years died due to road accident and thereafter, about 200 people including the petitioner assembled and started damaging the house of the informant and assaulting the informant and her family members and when the Police arrived then the situation was brought under control. Submission is of false implication and that the accident

Patna High Court Cr.Misc. No.10972 of 2018(2) dt.27-02-2018 2/3 took place on 20.07.2017 for which FIR was lodged by grandfather of deceased Kishan Das vide Purnahiya P. S. Case No. 60 of 2017 against the driver of the motorcycle namely, Roshan Kumar who is the son of the informant and thereafter, the informant after death of the son of Pintu Das the informant filed the instant case on 06.08.2017 with wrong allegations, in this case other co-accused Firangi Das and others have been allowed pre-arrest bail vide Cr. Misc. No. 54026 of 2017 and further Shatrughan Das and Bharat Das have been allowed prearrest bail vide Cr. Misc. no. 62327 of 2017 by another coordinate Benches of this Court, there is no specific allegation against the petitioner and as such the petitioner deserves sympathetic consideration.

Learned APP fairly submits that other co-accused have been allowed pre-arrest bail.

In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sheohar in connection with Purnahiya P. S. Case No. 62 of

Patna High Court Cr.Misc. No.10972 of 2018(2) dt.27-02-2018 3/3 2017, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
