JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Rajnagar P.S. Case No.55 of 2019 for the offence under Sections 147, 148, 323, 341, 379, 307, 504 and 506 of the Indian Penal Code. Subsequently, Section 302 of the IPC was added. Learned counsel appearing on behalf of the petitioner would submit that the petitioner has no criminal antecedent and he is in custody since 17.01.2020.

Having regard to the nature of allegations and gravity of offence against the petitioner, the Court is not inclined to grant bail to him. The prayer for bail is rejected for the time being.

However, the court below is directed to expedite the

Patna High Court CR. MISC. No.27210 of 2020(2) dt.02-11-2020 2/2 trial and conclude the same within a period of nine months. In the event the trial is not concluded within the stipulated time, the court below shall release the petitioner on bail on appropriate terms and conditions. The court below is under obligation to furnish reasons for non-conclusion of the trial within the time frame before Registrar (Vigilance) of this Court.
