JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-12-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307 and some other allied Sections of the Indian Penal Code and u/s 27 of Arms Act. As per the prosecution case, on the alleged date and time of occurrence, this petitioner along FIR named accused persons and five unknown persons, variously armed, came and surrounded the informant and this petitioner shot him from behind due to which informant sustained fire arm injuries. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case on account of some dispute. Petitioner and informant are neighbours. There is delay of 10 days in lodging the FIR and

Patna High Court CR. MISC. No.36268 of 2021(2) dt.09-12-2021 2/2 there is no injury report on record. Petitioner claims clean antecedent and is in custody since 12.01.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Mojahidpur Babarganj PS case No. 206/2020.
