JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-12-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 504,506 and 387 of the Indian Penal Code.

The prosecution case is that the informant runs a school when the petitioners demanded extortion and on refusal, land of the informant was encroached.

It is submitted by the learned counsel for the petitioners that informant is the younger brother's wife of the petitioners and due to land dispute the accusation has been levelled. Even assuming the accusation, no offence under section 387 IPC is made out and at best, a case under section 385 IPC is made out

Patna High Court Cr.Misc. No.54762 of 2015 (2) dt.04-12-2015 2/2 which is bailable. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent . Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Gaya in connection with Buniyadganj P.S. Case No.173 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
