The petitioner apprehends arrest in a case registered for the offence punishable under sections 413, 414/34 of the Indian Penal Code.

Police intercepted a person Sunil Kumar Mahto riding a motorcycle and recovered Rs. 10,000/- cash, some Aadhar cards, SIM cards, and one PAN card. He disclosed that the motorcycle was also stolen one and the same had been handed over by the petitioner to him to sell it.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the possession of the petitioner and save and except confessional

Patna High Court CR. MISC. No.27261 of 2020(2) dt.06-11-2020 2/2 statement of co-accused, who is co-villager and inimical to him, there is no other material against the petitioner. In para 3 of the bail petition it is stated that the petitioner has got no criminal antecedent.

In the facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah in Bettiah Town Police Station Case No. 633 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
