=========================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 17-10-2016 Heard learned counsel for the parties.

The petitioner apprehends arrest in connectin with Baniyapur P.S. Case No. 257 of 2013 dated 27.10.2013 instituted under Sections 341/307/504/34 of the Indian Penal Code and 27 of the Arms Act.

After some arguments, learned counsel for the petitioner seeks permission to withdraw the application with liberty to surrender before the Court below and seek regular bail. Learned A.P.P. does not oppose.

In view of the aforesaid, the application stands disposed off as withdrawn with liberty aforesaid. In the event the petitioner surrenders before the Court

Patna High Court Cr.Misc. No.44067 of 2016 dt.17-10-2016 2/2 below and seeks regular bail within one month from today, the same shall be considered on its own merits without being prejudiced by the present order, in accordance with law.

It goes without saying that the petitioner shall be at liberty to raise all the points available to him including grant of bail to co-accused.
