JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 09-11-2015 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case under sections 447, 448, 341, 323, 324, 379, 504/34 of the Indian Penal Code.

It is alleged that petitioner Nos. 2 and 3 assaulted the informant, Pramila Devi, with iron rod on account of which she sustained injuries.

The petitioners submit that there is a case and counter case between the parties.

Having regard to the facts and circumstances of the case, the petitioner No.1 Yogi Yadav is directed to be released on anticipatory bail, in the event of his arrest/surrender, on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each

Patna High Court Cr.Misc. No.48904 of 2015 (2) dt.09-11-2015 to the satisfaction of the Chief Judicial Magistrate, Darbhanga in Hayaghat P.S. Case No.59 of 2015.

So far as petitioner Nos. 2 and 3, namely, Rajesh Yadav and Mukesh Yadav, are concerned, they would surrender and pray for regular bail. If the learned trial Court finds that the injuries sustained by the informant are simple in nature, they too would be released on bail on furnishing bail bonds to the satisfaction of the trial court.
