2. The petitioners apprehend their arrest in connection with a registered the offence punishable under Sections 126(2)/115(2)/ 109/352/3(5) of the BNS.

3. The prosecution story in brief is that one Rohit Kr. Mandal has given a computerized complaint to the S.H.O., Araria P.S. on 05-01-2025 at 22:30 o'clock alleging therein that on 27.12.2024 at about 02:00 P.M., the elder brother of the informant namely, Deepak Kumar, was sprinkling insecticide in his field, at that time his uncle, Shyamlal Mandal and Bharat Kumar Mandal came there and started abusing his brother and

No.26339 of 2025(3) dt.02-09-2025 2/2 also told him why you had cut his 'AAR'/'MER' and thereafter they went from there and after sometimes, they came back along with wooden Pitna, spade & Dabiya & all of a sudden, accused Shyamlal Mandal assaulted his brother with intent to murder with Pitna and accused Bharat Kumar Mandal with Dabiya. As a result of the head injury, he became unconscious, had a face on the ground. After half an hour, the wife of his brother came there and having found her husband unconscious, started crying, thereafter he was admitted for treatment.

3. At the outset, learned counsel for the petitioners submits that they may be permitted to withdraw the petition and surrender before the Court concerned.

4. Permission is accorded, the petition stands dismissed.
