The petitioner apprehends his arrest in Guraru P.S. Case No. 78 of 2015 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act.
It is alleged that the petitioner and others put hindrance in taking the dead body of a boy. The accused persons indulged in brick batting and they also pelted stones causing injury to some of the police personnel.
Learned counsel for the petitioner submits that similarly situated co-accused Shyam Kumar Goswami in Cr. Misc. No. 11554 of 2016 on 01.04.2016, Jitendra Rajak in Cr. Misc. No.57384 of 2015 on 14.01.2016, Shatrughan Prasad @
Patna High Court Cr.Misc. No.48266 of 2016 (2) dt.14-12-2016 2/2 Shatrughna Prasad in Cr. Misc. No. 412 of 2016 on 07.01.2016 have already been granted anticipatory bail by different Benches of this Court.
Considering the facts aforesaid and the fact that the case of the petitioner stands on the same footing, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Guraru P.S.
