2. Application is filed for initiating a contempt petition against the opposite parties for their alleged willful
Patna High Court MJC No.796 of 2022(7) dt.31-10-2025 2/3 disobedience of the order of this Court dated 18.03.2016 passed by a Bench of this Court in C.W.J.C. No. 10294 of 2013 whereby while setting aside the proceeding of the land acquisition and notices issued therein to the petitioner, the respondents had given liberty to start a fresh proceeding for acquisition of the lands of the petitioners strictly in accordance with law.

Learned Advocate for the petitioner referring to the show cause affidavit filed on behalf of opposite party no. 2 has submitted that the respondent opposite party no. 2 himself admitted that the project initiated for acquisition of land for construction of sewerage treatment plant has already come to an end. The possession of the land has been taken and delivered to Nagar Parishad and almost all of the raiyats have received award of their acquired land, but the petitioner has not turned-up with some required documents for payment. The respondent opposite parties further submit that despite the aforesaid fact, they are ready to pay the award as per the new Act, but they have not turned-up.
4. Learned Advocate for the State, at the outset, submits that the present contempt petition is not maintainable in view of the delay in filing of the present application, besides the
Patna High Court MJC No.796 of 2022(7) dt.31-10-2025 3/3 nature of the order as has been passed by a Bench of this Court.
5. Having considered the submissions and taking note of the nature of the order, this Court does not persuade to continue with the contempt proceeding, accordingly the present contempt petition stands closed. However, the petitioner is at liberty to file appropriate petition, for redressal of his grievance. (Harish Kumar, J) supratim/- U
