For the Petitioner/s : Mr. Arvind Kumar, Advocate For the Respondent/s : Mr. Niraj Kumar, AC to GA-10 =========================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL JUDGMENT Date: 10-08-2017 This writ petition was filed on 16.10.2010 and it was the grievance of the petitioner at that point of time was that on a departmental enquiry conducted against the petitioner, the enquiry officer has submitted a report on 18.9.2008. The matter is pending since then and a final order on the enquiry report has not been passed. Even though more than two years have lapsed, neither the counsel for the petitioner nor for the State Government are aware as to whether any final orders on the enquiry report has been passed till date or not. The matter is pending since 2010 and is listed today for the first time before this Court.
Patna High Court CWJC No.18820 of 2010 dt.10-08-2017 2/2 Keeping in view the aforesaid, it is directed that upon the petitioner filing or the office forwarding a certified copy of this order to the departmental authorities, in case final orders with regard to the report submitted on 18.9.2008 has not been passed by the authorities till date, the same be now passed within 60 days from the date of receipt/production of a copy of this order. In case such an order has already been passed, the Department may communicate it to the petitioner.
Needless to emphasize that with regard to the action the petitioner shall have liberty to assail the same afresh in accordance with law including raising the grounds as are raised in this petition at that point of time.
