JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-12-2015 At the outset, it is submitted by learned counsel for the petitioner that petitioner no.1 Chhedi Singh has been arrested. Hence, this application so far as it relates to petitioner no.1 has become infructuous.
Heard learned counsels for the petitioners and the State.
The petitioner nos. 2 to 4 are apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 420,323 and 504 of the Indian
Patna High Court Cr.Misc. No.54755 of 2015 (2) dt.04-12-2015 2/3 Penal Code.
The prosecution case is that the complainant purchased the land from petitioner nos. 1 and 2 for consideration amount of Rs.17,50,000/- though consideration money mentioned in the sale deed is Rs.13,86,000/-. Subsequently, the complainant applied for mutation and came to know that the land is recorded in the name of the State of Bihar.
It is submitted by the learned counsel for the petitioners that petitioner no. 1 purchased the land from Gauri Shankar Singh and information was being supplied by the Circle Officer, Ramgarh suggesting that the land in question having Khata No. 214, Plot No. 97/1389 is recorded in the name of Chhedi Singh, Uma Shankar Singh, Ram Sudhir Singh and Vijay Kant Singh. More over, the complainant has also filed Money Suit No. 2 of 2014 for the same cause of action.
Considering the accusation in the background of land dispute, let the above named petitioner nos. 2 to 4 be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs.
Patna High Court Cr.Misc.
