The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 354 of the Indian Penal Code and Sections 66E, 67 and 67A of the Information Technology (Amendment) Act, 2008. The prosecution case as per the written report of Punam Kumari dated 23.02.2018 submitted to the Station House Officer, Madanpur P.S., to the effect that on 19.02.2018 at 9.00 A.M., she was enforced that fake I.D. was being made by morphing the picture of her face and someone else's body by the petitioner Shashi Kumar and co-accused Price Kumar. Patna High Court Cr.Misc. No.20783 of 2018 (2) dt.20-04-2018 petitioner that the accusation is levelled only on the basis of suspicion and a statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP, however, submits that the petitioner is named in the FIR.

Considering the nature of accusation coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 48 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
