JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-02-2018 Petitioners apprehend their arrest in connection with Sarsi P.S.Case No. 77 of 2017 registered for the offences under Sections 341, 327, 324, 354, 307, 379, 504 and 506 of the Indian Penal Code.
Allegation against the petitioners is of assault to the son of informant.
Submission of learned counsel for the petitioners is that there is general and omnibus allegation against the petitioners and five other accused persons and injuries are simple in nature and there is case and counter case between the parties. Heard learned APP also.
In the facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender, be released on bail
Patna High Court Cr.Misc. No.3921 of 2018 (2) dt.02-02-2018 2/2 on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sri Rohit Kumar, Judicial Magistrate, 1st Class, Purnea, in connection with Sarsi P.S. Case No. 77 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioners will co-operate in investigation and will appear before the Investigating Officer as and when required, except on genuine reason, failing which their bail bonds shall be cancelled.
