Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Madhepura Mahila PS case no. 02 of 2024, disclosing offences punishable under Sections 341, 323, 313, 376, 420, 504, 506/34 of the Indian Penal Code. 3.

The prosecution story, as per the First Information Report, is that the petitioner, on the pretext of marriage, established physical relationship with the informant. 4.

Learned Counsel for the petitioner submits that petitioner has falsely been implicated in this case with oblique motive in order to harass and force him to solemnize marriage with the informant. The petitioner is having a clean antecedent. Learned counsel further submits that the fact of the matter is

Learned counsel for the informant submits that the marriage of the petitioner has been solemnized with the informant.

Regard being had to the submissions made on behalf of the parties and taking into consideration the fact that the marriage of the petitioner and informant has already been solemnized, I am inclined to grant the privilege of anticipatory bail to the petitioner.

This application is, accordingly, allowed.

Let petitioner, abovenamed, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Madhepura in connection with Madhepura Mahila PS case no. 02 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
